### § 1 Scope and General Information
(1) These General Terms and Conditions (GTC) apply to all contracts and deliveries between Daniel Becker (time as a color) and consumers placing an order via our online shop (https://timeasacolor.com), as well as orders placed via our official storefronts on **eBay** and **Discogs**.
(2) A “consumer” is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.
(3) The contract language is exclusively **English**. All steps of the ordering process, descriptions, and checkouts are provided in English.
### § 2 Conclusion of Contract and Order Process
(1) The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order (invitatio ad offerendum).
(2) By clicking the “Add to Cart” button, checking your details, and completing the checkout process by sending the order, you submit a binding offer to purchase the goods in your cart.
(3) The contract is officially concluded when we accept your offer within one week, either by sending a separate order confirmation via email or by shipping the ordered items to you.
### § 3 Prices, Shipping Costs, and Payment Terms
(1) All prices listed in the shop include statutory Value Added Tax (VAT) where applicable, plus shipping costs. Packaging costs are already factored into our item prices.
(2) Payment can be made via **Advance Payment (Bank Transfer / Vorkasse)** or **PayPal**.
(3) If you choose Advance Payment, you agree to transfer the purchase price immediately after the conclusion of the contract. Shipment will only occur after the payment has been fully received.
### § 4 Shipping and Delivery
(1) Unless clearly stated otherwise in the product description, all physical items (vinyl records, CDs, cassettes, and merchandise) are ready for immediate dispatch.
(2) Retention of Title: All delivered goods remain the property of Daniel Becker until full payment has been received.
### § 5 Statutory Warranty Rights (Legal Guarantee)
(1) Consumers within the European Union are entitled to statutory warranty rights (legal guarantee of conformity) lasting for a minimum of two years from the delivery of the goods.

## 🚫 Right of Withdrawal & Crucial Exceptions (Widerrufsbelehrung)
### Right of Withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire 14 days from the day on which you (or a third party named by you) receive the physical goods.
To exercise your right of withdrawal, you must inform us (Daniel Becker, Hauptstr. 6, 83623 Dietramszell, Germany, E-Mail: mail@timeasacolor.com) of your decision by a clear statement (e.g., a letter sent by post or an email). You may use the digital cancellation option available in our shop footer or at https://timeasacolor.com.
### Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of supplementary costs resulting from your choice of a non-standard delivery type). We will carry out such reimbursement within 14 days from the day we receive your notification. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods.
**You shall bear the direct costs of returning the goods.** You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods (similar to inspecting items in a physical retail store).
### ⚠️ Important Exceptions to the Right of Withdrawal
In accordance with statutory EU regulations, the right of withdrawal **does not apply** to:
1. **Unsealed Audio or Video Recordings:** The right of withdrawal expires prematurely for audio or video recordings (such as **Schallplatten / Vinyl LPs, CDs, Cassettes**) if they were delivered in a sealed package or shrink-wrap and **the seal/shrink-wrap was broken or removed after delivery**.
2. **Event Tickets & Ticket Bundles:** The right of withdrawal does not apply to contracts for the provision of services related to leisure activities if the contract provides for a specific date or period of performance (this includes concert tickets and custom ticket-bundles, e.g., Ticket + T-Shirt).
3. **B2B Transactions:** Contracts where you act as an entrepreneur or commercial entity.
